1. Introduction

This privacy policy (“Policy”) describes the types of personal data you provide and/or Krehalon B.V. collect via your use of our website and interaction with our business services, what we may do with that personal data and your rights.

‘Personal data’ is defined in the Data Protection Law and is essentially information from which an individual person can be identified. By submitting information and/or continuing to use our website, you signify your consent to us using your personal data in accordance with the below.

We may need to change the terms of this Policy from time to time and changes will be posted on this page (and/or where appropriate, otherwise notified to you). Your continued use of our website and/or business services will be deemed to be acceptance of amendments we make.

Krehalon B.V. is the Data Controller.

Krehalon B.V. is a manufacturer and distributor of high-quality plastic packaging materials for the food industry and has direct sales operations in the Netherlands, France, Benelux, UK and Australia. Krehalon B.V. is a fully owned subsidiary of Kureha Corporation (based in Tokyo, Japan).

References to “we”, “us” and “our” in this policy are all references to Krehalon B.V..

3. How we collect information about you 

There are several ways we may collect information about you. These include:

  • when you provide it to us by getting in contact (phone/email/web enquiry/social media)
  • when you subscribe to our services or place an order with us
  • when you report a problem with our website or any of its services

This can include the following: name, date of birth, address, phone number, email address, job title, company name, company address, payment details where relevant, IP address, geographical location of where you accessed our website, information about how you use/interact with our website, information from cookies (if you have consented to their use, please check our Cookies Policy) and information about your computer or other electronic device (tablet and browser type).

5. How we use your information and the legal basis for this

Your information is used to process your purchases, deliver our services and contact you, as well as to improve the website experience for our users.

Therefore, we request that the information you provide is as accurate as possible as this allows us to secure your privacy in relation to registered services by differentiating you from others.

We use information about you for the following purposes:

5.1 To perform the services you have requested, such as when you purchase from us, we may collect the following information: name, date of birth, phone number, email address, address, billing address, company name (if applicable), VAT number (if applicable). If you don’t provide this information, you won’t be able to purchase from us or enter into a contract with us. In these instances, we process your personal data because it is necessary for the performance of a contract with you, or in order to take steps at your request to enter into a contract.

5.2 To alert you to offers, promotions, new products relating to Krehalon B.V. (where you have agreed to this). When you visit our website, send us an enquiry or purchase from us, you can opt in to receive marketing communications in relation to our products and services by ticking the relevant boxes. We will then send you the relevant marketing communications until such time that you remove your consent. In these instances, processing is performed on the basis of your consent.

5.3 To carry out market research or customer satisfaction surveys so that we can improve the products and services we offer. Your feedback is valued and helps to shape the products and services we offer or make available. You will have the right to opt-out of receiving or participating in our surveys at any time.

5.4 To manage and improve our websites. Information we use for this purpose may include (for example) that about your computer and, where available, your IP address, operating system and browser type.

We may also supplement the information that you provide with other information that we obtain from our dealings with you or which we receive from other organisations.

In addition, we reserve the right to perform statistical analysis of user behaviour and characteristics to measure interest in and use of the various areas of our website and to ascertain the number of users that have visited particular web pages. We also keep track of what you do with our newsletters when you receive them for trends and statistics and to evaluate the efficiency of our newsletter and information service. For example, whether you open, delete, or access links contained in the newsletter.

6. Who we share your data with

We will only share your data with third parties for the purposes of delivering our services, fulfilling any contracts we enter with you, where required by law or to enforce our legal rights.

6.1 Third party communications

Krehalon B.V. will not disclose your details to third parties for the purpose of receiving communications from those third parties, including relevant business information, unless you specifically opt-in to this type of communication.

6.2 Service providers

Only when necessary to deliver our services and run our business, we share your information with various providers who will act as data processors. These may include:

  • Telephone and email providers
  • Payment processing providers
  • IT service providers
  • Logistics companies
  • Mailing houses and print/fulfilment companies

6.3 Mailing, print and fulfilment companies

Krehalon B.V. will only disclose your information to print and fulfilment companies who are conducting business on Krehalon’s behalf and only for an agreed purpose, such as marketing mailings. Data is securely encrypted and, once the purpose for which it was transferred is complete, it is deleted.

6.4 Sharing your information for legal reasons

Krehalon B.V. will share your information when required to do so in order to comply with a common law or statutory obligation. For example, this may include:

  • If we are under a duty to disclose or share your personal data to comply with any legal obligation, or to enforce or apply any of our other applicable terms and conditions and other agreements; and/or
  • to protect the rights, property, or safety of us, our commercial partners, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

6.5 Company acquisition

If we or substantially all of our assets are acquired by a third party, in this case personal data held by us about customers will be one of the transferred assets.

6.6 Transfer of your information outside the European Economic Area (EEA)

We will only transfer information outside de EEA within the Kureha corporation of allied companies.

7. How long we retain your data

We will keep hold of your data for no longer than necessary. The length of time we retain it will depend on any legal obligations we have (such as tax recording purposes), the nature of any contracts we have in place with you, the existence of your consent or our legitimate interests as a business.

7.1 Purchases

When you purchase from us, we retain that information for a period of six years following the end of the financial year during which you purchased from us. It is our legal obligation to keep these records for tax purposes.

7.2 Enquiries

Unless you provide consent for future contact during your enquiry, we will keep your information for as long as required to respond and complete your enquiry, and for a further 12 months, before deleting your information.

7.3 Newsletter subscriptions

When you subscribe to our newsletter, we will retain your data until such time that you remove your consent. In these instances, retaining and processing of your data is performed on the basis of your consent.

8. Profiling and automated decision making

Details on your interactions with Krehalon B.V. may be used to review the relevance and quality of the products and services we offer. However, we do not undertake any automated profiling or automated decision-making processes.

9. Your rights

Subject to certain limitations, you have the right to:

9.1 Request a copy of the information we hold about you and be told about its use.

9.2 Request that Krehalon B.V. rectifies, deletes or restricts processing of your information if you have concerns over its accuracy, deletion or fair and lawful use.

9.3 Object to the processing of your personal data, based on your particular situation, where this processing is based on the legitimate interests of Krehalon B.V., where it involves direct marketing, or where it is completed for research or statistical purposes.

9.4 Withdraw consent to the use of your information. All of our non-operational communications contain an unsubscribe link and you can withdraw consent at any time.

9.5 Receive your personal data in a portable, commonly used, machine-readable format to transfer to another data controller. However, in some circumstances we may be unable to provide you with some or all of your personal data, for example, if it compromises the confidentiality of a third party.

Krehalon B.V. will action on your request regarding any of the above listed rights without undue delay and at least within a month of the request. Given the complexity of the request, Krehalon B.V. retains the right to extend this timeframe under the condition that you, as the data subject, are notified of the new timeframe within a month.

Under the General Data Protection Regulation, Krehalon B.V. retains the right to charge a ‘reasonable’ fee to cover administrative costs of processing any of the above requests from the data subject should the request be considered manifestly unfounded or excessive. Krehalon B.V. can also refuse to honour the request as long as it is explained why, and data subject is informed of their right to complain to a supervisory authority and to receive a judicial remedy.

10.1 Links to third party websites & services

We are not responsible or liable for the content, privacy policies or services offered by websites or apps other than our website, including those which are linked to from any of our website pages. We encourage you to read and familiarise yourself with the privacy policies, terms and conditions and/or other notices on other websites you visit.

10.2 Children and young people

We realise and understand that children and young people, including those under 18 years of age (“minors”) may visit our website. It is our policy:

  • to encourage all minors to consult with their parents or legal guardian before submitting or requesting any content or information to/from us or other third parties. Users of the website, who indicate they are a minor may be asked to provide a valid email address for their parent or guardian so that we may (providing they have their parent or guardian’s permission) verify parental consent, where required;
  • not to make a minor’s participation in our activity contingent on the child disclosing any more personal information than is reasonably necessary in order to do so.
  • not to actively market to minors; and
  • not use (or pass to any third party) personal information on persons known to be minors for any commercial purposes.

Statistics on visitors activity and website usage are gathered using Google Analytics. Google comply with the Eu-US Privacy Shield Framework.

10.5 Google Analytics

Google Analytics uses cookies to gain information about the use that is made of pages on the applicable Online Facilities. We use the information from these cookies to generate reports on the usage of the applicable Online Facilities which are used for evaluation and analysis. The purpose is to improve the Online Facilities by tailoring them to the needs of users.

In such cases, no data which is in itself specific to any identifiable user is retained.

In addition to standard analytics parameters, we receive data via Google Analytics Advertising Features including information about ‘Demographics and Interest Reporting’ which gives us greater insight into the types of visitors we receive.
